Terms and Conditions of Sale – Aïga Viva

1. Introduction

These Terms and Conditions of Sale are entered into between, on the one hand, the sole proprietorship Zoé Dufour, trading under the name Aïga Viva, with its principal place of business located at 5 rue Bonaparte, 06300 NICE.

and, on the other hand, by any individual or legal entity wishing to make a reservation through “Aïga Viva.”

2. Services

Aïga Viva offers guided activities in natural settings, including in particular:

  • Snorkeling
  • Introduction to freediving
  • Freediving lessons
  • Wellness sports sessions for individuals interested in health-focused and adapted sports related to water and breathing

Services are provided in small groups of up to 6 people to ensure safety, quality, and comfort.

3. Reservations

All reservations must be made via the website, by email, or by phone.

Reservations are confirmed upon receipt of full payment.

Aïga Viva reserves the right to refuse a reservation in the event of unsuitable conditions or if the maximum number of participants has been reached.

4. Rates and Payment

Prices are listed in euros (€).

Unless otherwise stated, services include:

  • Instruction
  • Equipment (mask, fins, snorkel, wetsuit if necessary)
  • Payment can be made in the following ways:

Online payment,

  • Cash,
  • Bank transfer (immediate if within 7 days).

5. Cancellation Policy

​5.1. Cancellation by the customer:

In accordance with Articles L.121-20 et seq. of the French Consumer Code, the customer has a period of seven (7) clear days to exercise their right of withdrawal without having to provide a reason or pay any penalties. The seven-day period begins on the date of receipt of the written confirmation of the stay at Aïga Viva.

No refund of any kind (rescheduling, cash, etc.) will be issued for any activity that has already begun if the cancellation is initiated by the customer, regardless of the reason.

Cancellation must be notified in writing (via email to the business address contact@aigaviva.com or by mail to Aïga Viva – 5 rue Bonaparte 06300 NICE, postmark serving as proof, and excluding any other messaging services: SMS, WhatsApp, Facebook, Messenger, etc.).

Once the reservation is final (i.e., a deposit has been paid), any cancellation, regardless of the cause, may be subject to a full or partial refund depending on the date of cancellation.

The refund amount depends on the cancellation date:

1) For individual guests, the following conditions apply for a full cancellation of the stay:

More than 20 days before the start of the stay: 50% refund of the amount paid

Less than 20 days before the start of the stay: no refund

5.2. Cancellation by Aïga Viva:

Aïga Viva may be required to cancel the entire service in the event of force majeure: physical, meteorological, geopolitical, technical, or material impossibility, or any event that could affect safety conditions or the proper conduct of the trip.

In this case, Aïga Viva undertakes to issue the customer a credit note for the full amount paid. Aïga Viva will propose new dates for rescheduling the trip, excluding any compensation.

In the event that a postponement is not possible, in accordance with the provisions of Article R.211-10 of the Tourism Code, if Aïga Viva is forced to cancel a trip, the customer will be notified by email, and Aïga Viva undertakes to refund the customer the amounts already paid, excluding any compensation.

When the service is subject to the condition of a minimum number of participants and provided that the customer was notified of this at the time of booking, cancellation due to an insufficient number of participants must occur at least 7 days before the start of the service. The customer would be refunded the full amount paid but would not be entitled to any compensation.

6. Physical Fitness and Participation

The participant declares that they:

  • can swim
  • are in good physical condition
  • have no medical conditions that would prevent them from practicing freediving or snorkeling

If in doubt, a medical consultation is recommended.

Aïga Viva reserves the right to refuse participation if safety requirements are not met.

7. Liability and Insurance

Aïga Viva is covered by professional liability insurance.

Each participant remains responsible for their own safety and behavior during the activity.

It is recommended that participants have personal insurance.

8. Conduct and Safety

Participants agree to:

  • follow the safety instructions given by the instructor
  • behave respectfully toward the group and the environment

Any dangerous or inappropriate behavior may result in exclusion without refund.

9. Image Rights

Photos or videos may be taken during the activities.

Unless otherwise specified in writing, the participant authorizes Aïga Viva to use this content for communication purposes (website, social media).

10. Respect for the Environment

Participants agree to:

  • respect marine flora and fauna
  • refrain from taking or damaging anything
  • adopt a responsible and mindful attitude

11. Personal Data

The information collected during the booking process is used solely for the purposes of the activity.

It is neither sold nor shared with third parties.

In accordance with applicable regulations, each participant has the right to access, modify, and delete their data.

12. Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable resolution will be sought before any legal action is taken.
